## **What to watch out for when leaving Germany**


If you’re leaving Germany, you’ll need to watch out for a few important things: 


### *[Abmeldung](https://allaboutberlin.com/glossary/Abmeldung)* — Deregistration


When you first arrived in Germany, one of your first experiences was probably trying to obtain the coveted *Anmeldung*, or registration. Well, it turns out that you need to get a deregistration form too when you leave. ### Cancel your work contract 3 months in advance


You’ll need to cancel your working contract 3 months before leaving Germany. The only exceptions to this are if you are not working full\-time or your employer has signed an agreement with you for an earlier termination date.


### Cancel everything early


Contracts for things like your apartment have to be cancelled **three months in advance**. For your phone bill, gym and other local contracts you have, you can provide proof that you’re leaving with the *Abmeldung* (deregistration), plane tickets or new working contract to cancel early. 


Cancel in person and get written proof that this has been done. Remember that sometimes you will need to receive a letter in the mail, sign it and send it back to cancel some contracts. 


### Mark your bank account as “dormant”


When you do this, make sure that you look back at each automatic payment to switch over to your new international account like Netflix, Spotify or Amazon. If your account ends up in the negatives, the bank might decide to start an international address inquiry which is quite expensive.


### Prepare your pension refund documents


As mentioned in a previous article, you can get your pension payments back if you have worked in Germany for less than five years. After five years, you’re entitled to recieve pension benefits, so you are no longer eligible at this point.

## **Things to watch out for when returning to Germany**

## **Coordination rules**


Each country in the European Economic Area has its own social security system which includes things like pension contributions, health insurance, and other benefits. When looking at the overall systems of each of the countries, things get to be quite complicated.   
  
The European Health Insurance Card or in short EHIC was established by regulation 883/2004 on the 1st of June 2004 until 31 December 2005 when on the 1st of January 2006, it was implemented and accepted by 30 countries.

Instead of creating a universal system for each participating country to adapt to, the goal was to coordinate the systems. What this means is that each system will cover the people dependent on them (this includes both EU and non\-EU citizens given that they are covered under the public insurance system in an EU country).   
  
These coordination rules were also modernized in 2010 under regulation 987/2009 which have since simplified the process between countries and make sure that those moving within the EU face no disadvantages in terms of social security rights when doing so.  
  
Because social security is a basic human right included in articles 22 to 27 in the International Human Rights Law. Because of that, Germany has worked to create social security agreements with several countries.

## **The European Health Insurance Card**


From these coordination rules, the European Union established the European Health Insurance Card (EHIC).   
  
To apply for this card, people insured under public insurance systems in one of the countries listed above can contact their insurance provider.   
  
*Please note: if you are a non\-EU citizen and have the EHIC, you are not covered in Iceland, Denmark, Liechtenstein, Norway, or Switzerland.*   
  
You can use the card when you’re residing in another country in the list above, but please also note this is not travel insurance, so it won’t cover costs such as a return flight home or stolen property.    
  
Instead, the card covers what would normally be covered by the insurance provider who issued it like treating chronic or existing illnesses, pregnancy, and childbirth among other benefits. The EHIC provides coverage from the country in which you obtained the card, so if your card was issued in Spain under the public insurance system, and you are in Germany, you would need to look at the guide for Spain and not Germany.


###### **If you plan on moving long\-term to another EU country and not working, you will need to register your insurance with the [S1 form](https://europa.eu/youreurope/citizens/work/social-security-forms/index_en.htm) that you’ll need to request from your current health insurance provider.**


Depending on your circumstances as well, you may need to apply for health insurance in your new country of residence. This generally happens when moving to another country with the intention of working.   
  
Still, these regulations differ so greatly that we cannot make a general recommendation. Instead, you should look at the [European Commission’s website](https://ec.europa.eu/social/main.jsp?catId=849&langId=en) to learn more about each country and its regulations.


## **The EHIC for students**


Non\-working students are generally able to use their EHIC after filing the S1 form for longer residencies abroad without a problem. There are, however, a few things to keep in mind that might impact your coverage in your new country.   
  
Some countries will only cover students for a limited period of time when they’re abroad. You should contact your insurance provider for the S1 form and the EHIC and ask them if there are any time limits when changing your residency to another country on the list above. For older students (starting at around 28\), this is almost always the case.   
  
Ph.D. students can also run into problems as some countries consider them resident workers regardless of pay. This means they might need to get either public or private insurance when moving abroad. This information can be found through contacting the university they will be completing their Ph.D. at.   
  
It’s also important to still file the S1 form which you will receive and submit to your current insurance provider connected with your EHIC. If your current insurance card is not also automatically an EHIC, you will also need to apply for the EHIC before leaving, so there is no lapse in coverage.   
  
If a student begins working in the new country of residence, they will almost certainly be required to register for that country’s public health insurance. Because the system is not only dependent on which country you are from, but also which insurance you hold in that country along with your reasons for being in Germany, we cannot confidently make a good recommendation for you. Instead, we highly recommend speaking with your insurance before coming to Germany to make sure there is no accidental lapse in coverage.


## **Retiring abroad**


Health insurance abroad after 55 is incredibly tricky, so having the EHIC to fall back on has major benefits. However, as always, there are some things you need to watch out for.   
  
If you are receiving a pension from the country you live in, that country is responsible for your health insurance regardless of pensions received from other countries on the list above.  
  
If you’re not receiving a pension or income from the country you currently live in, you can receive the medical treatment that would be covered in the country where you are drawing your pension from. So, for example, if you worked in Italy for several years, but are originally from France, and then moved to Italy to retire, you would receive the Italian pension and receive Italian healthcare, excluding you from the French system.   
  
Generally, you are only able to seek medical treatment in the country in which you live, but if your pension is from one of the following countries, you are entitled to medical treatment in that country and the country in which you are currently residing:

Depending on your situation, country of origin, countries in which you worked and the current country in which you reside, your health insurance coverage might change even with the EHIC.

How to get your German pension back

Get ready because you probably haven’t seen bureaucracy this dense before. It’ll be difficult, but if you follow all of the rules, you could potentially get several thousand euros back from your German pension, so it’s worth taking some time to figure it out. We’ve also tried to answer any questions you might have along the way!


## Factors that go into claiming a pension refund in Germany


1. Citizenship;
2. How long you worked in Germany;
3. How much your gross salary was;
4. And, where you are currently living.

He provided us with a fictional example to show how much someone could get back:


*Shahid is a software engineer from Egypt who came to Berlin in April 2016\. He stayed for a little over four years until the end of August 2020 (53 months in total). He earned an average gross monthly salary of 4\.5k for this time before moving to Saudi Arabia. After filing for a pension refund, he can expect to receive about €22,200\.*


*Shahid will have to wait until September 2022 to file for this refund since there is a mandatory 24\-month waiting period.*

## **How do I file to claim my German pension?**


You can use the [online process](https://www.pension-refund.com/) of Pension Refund Germany or do the work yourself.


### **1\. Download and begin to fill out the V0900 form**


First, you’ll need to fill out one of the following forms: V0901 (English / German), V0902 (French / German), or the original V0900 (only German). There are a few differences between the documents as we did, and while V0901 and V0902 should be acceptable for filing, we recommend using them to fill in the information for V0900

### **2\. Section 5 – Insurance history**


You might have been fine until this section, but then it asks you for **all insurance documents**. There was also probably a moment of panicked searching through that one binder of German documents you gathered throughout your stay. 


#### You’ll need to request these documents:


- *Versicherungsverlauf* (insurance history) which you can request through the *Deutsche Rentenversicherung* (German Pension Insurance).
- A second *Versicherungsverlauf* (insurance history) with all insurances you had in Germany.
- You should also attach your *Lohnsteuerbescheinigungen* (income tax certificates) for each financial year you worked in Germany.
	- You can request these from your employer(s).


If you’re insured under private or public health insurance at Feather, then you can request these documents by [emailing us](https://feather-insurance.com/support). We will provide you with proof of insurance along with proof of payment for the entirety of the time you were insured through us. 


###### **Important**: if you answer “yes” to the question about gaps in insurance in section 5, you’ll need to fill out the additional form V0105 to include all timeframes where these gaps take place. This document does not come in languages other than German.


### **3\. Creating a De\-mail account**


Most people filing for pension reimbursement no longer have a German address. Just the requirement that filing is done a minimum of 24 months after proof that you’ve left the country almost guarantees that you’d no longer have a mailing address. 


Thankfully, there is a way around this. You can make a [de\-mail account](https://produkte.web.de/de-mail/deutsche-rentenversicherung/) with Web.de who partner with the German pension insurance. With this email, you can receive secure communication without needing a mailbox.


**Please note**: The registration requires a European address which would disqualify you from receiving the pension, so it’s a good idea to make this email before leaving Germany and save the credentials for when it’s time to apply. 


### **4\. Creating an online pension insurance account**


A few of the documents you’ll need require a formal request from the German pension insurance. If you look closely, you’ll see that they don’t allow for a country or alternative address outside of Germany for this information. 


To be able to request documents from them online, we suggest you make an account before leaving Germany to have the documents be sent to your De\-mail account.

## **German pension refund companies**


If you haven’t already read our guide on getting your pension insurance back, then you should check it out first because it outlines everything you need to know. In this article, we’ll be expanding on this topic to include German pension refund companies and what to watch out for when hiring them.


### **Hidden processing fees**


Unless you read our first article, you probably didn’t know that some people won’t qualify to get their pension back. It really comes down to how long you worked in Germany, where you’re from, how long you’ve been gone, and how much you earned. 


Pension refund companies can check this relatively easily, but it means that they wouldn’t be able to charge processing fees for the obvious cases that a pension refund isn’t available. That’s why they’ll go through the process of applying for the pension refund even when they know it won’t go through to charge you a processing fee. 


If you go into the fee tab of most pension refund companies, you’ll see a small fee listed at the top of their website that’s about €100, but if you scroll down, there is a “minimum fee” (about €900\) and a “maximum fee” (about €2500\) which is all for processing and excludes the 10% fee taken directly from your pension refund. 


You will be charged these fees regardless of if you’re eligible for your pension refund or not. If a website does not list its fees, it might be best not to use that company.


### **Lump sum and legal fees**


All pension refund companies function on the basis of lump sum fees after you get your refund back. The fee should be about 10% and 15% for the most expensive companies. These fees should be listed on the website. 


Our partners at Refund German Pension Insurance only charge a fee of 10%, and they won’t charge additional hidden fees for legal costs either. Most of the time, the documents just need to be sent to an address and filed in German, so the process isn’t as complicated as it seems if you’re in Germany. Problems arise because you have to prove you’ve lived outside of Germany for at least two years to apply for the refund and then need to hand in more documents that are sent to your German address. 


The legal fees are almost never needed for this reason, so you should consider it a red flag if the company you’re working with can’t justify the use of a lawyer. We have seen problems with people’s documents getting stuck in limbo for an unacceptable amount of time, and a lawyer has needed to send a letter threatening legal action, but this is rarely the case.

#### **Additional information:**


**I am filing for someone else. What do I need to do?** If you are filing for someone else, you’ll need to prove that you are legally allowed to do so. They accept proof through a power of attorney or a court mandate. 

  **I am filing for someone else who is deceased. What do I need to know?** If the person you are filing for is deceased, you’ll need to attach a death certificate. Please note that this needs to be the original document. Notarized documents outside of Germany are not officially recognized.   
  
Some certificates are also not recognized or must go through a “research process” by the German government to verify their validity. 

  **What are the timeframes?** We recommend starting the process for your pension refund application before you leave Germany. This will give you time to set up online accounts to enable a digital application process. You can see examples of this in steps 3 and 4 above.   
  
Otherwise, the timeframes are as follows:  
1\. You have to work less than 60 months or 5 years in Germany to apply.  
2\. You have to have proof that you are leaving Germany (Abmeldung or deregistration)  
3\. After 24 months of moving to a Non\-European country, you can submit the application

  **Why can’t I claim my pension if I stay longer than 5 years?** Pension reimbursement is only for people who cannot claim a pension when they reach the age of retirement and live outside of the European Union.   
  
German pension insurance has a minimum of 5 years of contributions to be able to benefit from their retirement plan. This means anyone who contributes to German pension insurance for more than 5 years should be eligible to receive benefits. 

  **What do I need?** You’ll need to go to the website of the German Pension Insurance (Deutsche  
 Rentenversicherung) to download the forms:   
- V0900 \[Everyone needs to file this]  
- V0910 \[Additional information to V0900]  
- V0901 \[Englsih / German cheat sheet for V0900]  
- V0902 \[French / German cheat sheet for V0900]  
- German power of attorney \[when filing for someone else]  
- V0105 \[For employment gaps]  
- V0100 \[Additional space for V0105]  
- V0110 \[Form to explain why employment gaps happened]  
- Additional forms need to be downloaded depending on the reasons for employment gaps  
  
Along with these forms from the website of the Deutsche Rentenversicherung, you’ll need:   
– Visa and valid form of identification

– A complete history of your insurance coverage while working in Germany

It’s the most common visa type for short stays in Germany and other European countries within the Schengen Area.

## What is the Schengen area?


[The Schengen Area](https://home-affairs.ec.europa.eu/policies/schengen/schengen-area_en) is a group of 27 European countries that have agreed to abolish passport and border controls at their mutual borders. This means you can travel freely between these countries without needing additional visas or border checks, much like moving between states in the U.S.


The Schengen countries include popular destinations like Germany, France, Italy, Spain, Switzerland, Austria, and the Netherlands. 


## What is a Schengen visa?


The Schengen visa is a short\-stay visa that allows you to travel within the Schengen area for up to 90 days within a 180\-day period. If your primary destination is Germany, you must apply for your Schengen visa at the German embassy or consulate in your home country.


The German Schengen visa is typically issued for:


- Tourism
- Visiting family or friends
- Business trips
- Attending short courses or conferences
- Medical treatment
- Cultural or sports events.


The Schengen visa does not allow you to work or study in Germany long\-term. If that is your intention, then you would need to apply for a long\-stay visa instead. 


## Who needs a Schengen visa to visit Germany?


Whether you need a Schengen Visa depends on your nationality.


You need a Schengen visa if you are a citizen of:


- Most African countries
- Most Asian countries
- Russia
- India
- Turkey


You do not need a Schengen visa if you are a citizen of:


- The EU or EEA
- The USA, Canada, Australia, New Zealand, Japan, South Korea, Singapore, and a few other countries (for stays up to 90 days).


## How long can you stay in Germany with a Schengen visa?


You can spend up to three months in Germany or any other Schengen country within the Schengen visa’s 180\-day window. Days can be continuous or spread out over multiple entries into the country, depending on whether you receive a single\-entry or multiple\-entry visa.


Once you reach the 90\-day limit, you must leave the Schengen area. Overstaying your visa can result in fines, deportation, and difficulties re\-entering the Schengen zone in the future.


## Schengen visa requirements: what you’ll need to apply


When applying for a Schengen visa, the German embassy will ask you to submit several documents to verify the purpose of your trip, your financial situation, and your insurance coverage:


### Completed visa application form


You can download the Schengen visa form directly from the website of your [local German embassy or consulate](https://www.auswaertiges-amt.de/en/about-us/auslandsvertretungen/deutsche-auslandsvertretungen). Be sure to fill it out carefully, sign it, and prepare two copies.


### Valid passport


Your passport must be valid for at least three months beyond your intended stay and have at least two blank pages for visa stamps.


### Passport photos


You’ll need to submit two biometric passport photos that meet official [Germany visa photo requirements](https://www.germany.info/resource/blob/906790/6e3eee9fd4d86e16aaefe0e92d809332/dd-sample-photos-data.pdf).


### Reason for travel


Depending on why you’re visiting Germany, you will need to provide:


- A travel itinerary (including flight bookings and hotel reservations)
- An [invitation letter](https://feather-insurance.com/blog/invitation-letter) for visiting family or friends
- Confirmation of conference, seminar, or event attendance
- Business meeting invitations, if applicable.


### Travel health insurance


Travel health insurance is essential for Schengen visa approval. Your policy must:


- Be valid for all Schengen countries
- Cover the entire duration of your stay
- Include emergency medical care and repatriation

You must prove that you can financially support yourself during your stay. This can include:


- Recent bank statements
- Payslips

As part of your Schengen visa application, you must also provide evidence of where you’ll be staying during your visit, such as hotel reservations or a written invitation from your host.


### Proof of return


As this is a short\-term visa with an expiry date, you should be prepared to show a return flight reservation or, at least, proof that you plan to leave the Schengen area before your visa expires.


## How to apply for a Schengen visa: step\-by\-step


1. **Find your local German embassy or consulate.** [Each embassy](https://www.auswaertiges-amt.de/en/about-us/auslandsvertretungen/deutsche-auslandsvertretungen) may have slightly different procedures, so be sure to check the specific instructions on their website.
2. **Book your visa appointment.** Appointments can fill up quickly, so it’s always best to book well in advance, ideally at least two to three months before your planned trip.
3. **Prepare all required documents.** Double\-check the list from your embassy to ensure that nothing is missing before attending your appointment.
4. **Submit your application in person.** You will hand in your documents, pay the visa fee (around €80 for adults), provide biometric data and possibly attend a brief interview too.
5. **Wait for processing.** Schengen visa processing typically takes 15 calendar days, but it can take longer during busy periods. Allow a further two to three working days for the return of your passport. Don’t leave it all until the last minute!
6. **Receive your visa.** Once approved, your visa will be stamped into your passport, indicating the validity period and the number of entries you are allowed.


## What you can and can’t do on a Schengen visa


### It’s important to be absolutely clear about what the Schengen visa covers you for before applying.You can:


- Travel within Germany and other Schengen countries
- Attend business meetings, conferences and short courses
- Visit family and friends
- Receive emergency medical care
- Explore tourist attractions and cultural sites


### You can’t:


- Work for a German employer
- Enrol in long\-term study programs
- Extend your stay beyond 90 days without special approval (more on this below)
- Apply for permanent residence using a Schengen visa


Trying to work or stay beyond the allowed period can lead to serious legal consequences and may impact your ability to obtain future visas.  



How to extend your Schengen visa


Extending a Schengen visa is challenging but possible under specific circumstances. 


If you find yourself needing to be in Germany for more than 180 days due to exceptional reasons such as medical emergencies, flight cancellations or other unforeseen events, you may apply for an extension at the immigration office (Ausländerbehörde). 


It is crucial to do this before your visa expires, ideally as soon as the need for an extension becomes clear.


To apply, you will need to provide strong documentation supporting your request, such as a medical certificate, proof of financial means, travel insurance, and a valid reason that complies with the acceptable grounds for extension. Visa extensions are not guaranteed, and overstaying without permission can lead to penalties or entry bans. 


## How to prepare for your visit to Germany


A little bit of preparation goes a long way in making your time in Germany smooth and stress\-free. Here are a few essentials to get sorted before or shortly after you land:


### Choose a SIM card


Staying connected is key. Germany has several major mobile providers like Telekom, Vodafone and O2, each offering prepaid and contract options. For short stays or flexibility, prepaid SIMs from brands like Aldi Talk or Lebara are affordable and easy to set up. 


### Open a EUR bank account


Having a euro bank account makes everyday payments and rent much easier. Digital banks like N26 and Revolut are great for newcomers, offering fast online setup and English\-language support. Traditional banks like Deutsche Bank or Commerzbank are great for longer stays.


Find short stay accommodation


Temporary housing options are plentiful in Germany. For budget travellers, Hostel World is a good place to start. For private stays or shared flats, try Airbnb, Wimdu or Booking.com. It’s best to book early during peak times and always check reviews to ensure a reliable experience.

How to find a therapist in Germany

Finding a therapist in Germany is simply a nightmare. That goes for both Germans and expats as they try to navigate the system. Questions many have included which therapists are covered under which insurances or where I can see a list of approved therapists. Thankfully, we already have an article explaining the [difference between private and public insurance](https://feather-insurance.com/blog/mental-health-insurance/) regarding mental health. 


Once you’re done over there, you can come back, and we’ll talk about the process of actually finding a therapist in Germany. ## **1\. How to find a therapist in Germany**


The first major obstacle you’ll probably encounter is finding a therapist nearby who can speak English (or your native language). You may also need a therapist that has a specific specialty like gender identity, anxiety, depression, personality disorders, etc. 


Thankfully, the most widely used portal, [therapie.de](https://www.therapie.de/psyche/info/), is an excellent place to start. If you don’t have Google Chrome which can be set to [automatically translate](https://www.howtogeek.com/407924/how-to-turn-translation-on-or-off-in-chrome/) a website into English, scroll down to the bottom of the page where you will find “*Psychotherapeuten\-Suche*,” which translates to “search for psychotherapists.”


You’ll then need to enter your zip code in the “*Ort oder PLZ*” search bar after selecting the language you need in the dropdown menu titled “*Sprache*.” The other options allow you to choose what specialty you’d like the therapist to have, which insurances they accept and how long their waiting list is. 


Alongside therapie.de, there are also websites like [arztsuche.kbv.de](https://arztsuche.kbv.de/pages/arztsuche.xhtml) and our personal favorite, [Doctolib](https://www.doctolib.de/)!


  
\*Please note that many therapists may *immediately* refuse to put you on a waiting list if you are insured through public insurance. This actually allows you to go through the *Kostenerstattung*, or reimbursement process, where you prove to your insurance provider that no publicly accepted therapists are available. If that is the case, public insurance will pay for a private therapist. This process can take some time and be quite complicated, which is why we have the details below!


## **2\. What if you can’t find a therapist**


As you might have already guessed, finding a therapist on public health insurance is incredibly difficult. For some people who desperately need this service, the task may seem almost insurmountable. Even [Germans have a hard time finding a therapist](https://psychotherapierodenkirchen.de/kostenuebernahme.html#gesetzlich) or going through the *Kostenerstattung* (reimbursement) process.


There might very well come a time when you have to choose between three options:


1. Pay out of pocket;
2. Switch to [private health insurance](https://feather-insurance.com/private-health-insurance);
3. Or fight for the *Kostenerstattung* (reimbursement).


## **3\. Paying out of pocket for a therapist**


With millions of people struggling with mental health, [the European Commission](https://ec.europa.eu/health/non_communicable_diseases/events/ev_20210510_en) held an event in May to discuss the impact COVID\-19 had on the current system and what changes will need to happen in the future. 


And, although therapy and mental health have gained significant traction over the last decade and accelerated during COVID\-19, we still need to build to accommodate the increase in demand, which might take some time as students need to complete their degrees and training to eventually become certified. Even then, they might still open private practices.


So, the question remains, how do you find and pay for therapy if your current health insurance won’t cover it? You can use many of the same websites listed in the first section, like [therapie.de](https://www.therapie.de/psyche/info/), [Doctolib](https://www.doctolib.de/), or [Arztsuche](https://arztsuche.kbv.de/pages/arztsuche.xhtml) to look for therapists and their hourly rates. 


Another new website is [It’s Complicated](https://complicated.life/find-a-therapist). They’re a Berlin\-based startup looking to create an international community for therapy to make finding a therapist a bit easier. One of the best things about their website is that you can immediately see the cost before looking at the profile.


## **4\. Switching to private health insurance**


If you already have private insurance, your plan should have information on therapy options. Otherwise, for people who have public insurance, there are a few things to consider when [switching to private health insurance](https://feather-insurance.com/blog/health-insurance-guide-private-health-insurance), which we’ve covered before! Private insurance is where it starts to get a bit tricky. We’ve mentioned before that if you’ve had psychological treatment in the last 5\-10 years (depending on the policy), you likely will **not** receive coverage. When you sign up for private insurance, the insurer requires you to disclose pre\-existing conditions, including previous psychotherapy.

## **5\. Private therapy through** ***Kostenerstattung*** **(reimbursement)**


You’ve gone through switching to private and paying out of pocket and have decided that you’re ready to duke it out with some German bureaucracy? Well, we’ve done some digging and found a few things that might help you prepare. 


Public insurance started [the reimbursement process](https://www.therapie.de/psyche/info/fragen/wichtigste-fragen/psychotherapie-kostenerstattung/) in 2017 to allow public patients to tap into the private therapy sector until (hopefully) enough new therapists finish their training and begin working in the public sector. This means that this system is new and changing quickly, so it’s good to speak to your potential future therapist throughout because they’ll be the most extensive resource to you when it comes to winning a reimbursement claim. 


### Step One:


First, make sure that you visit a psychotherapist during their office hours **before** applying for reimbursement or beginning treatment. This might seem counterintuitive, but it will help support and strengthen your case with your public insurance provider. 


### Step Two:


Next, you need to make sure that the therapist has already been through the reimbursement process. This allows you to prove that their treatment and financial cost are equal to public therapists as they have been accepted before. If this isn’t the case, your public provider is likely to turn it down for these two reasons.


While these are two of the most important steps, you’ll also need to call and be denied entry to waiting lists from a certain number\* of therapists available to you on the public market. This is why, if you have tried in the past, a therapist might have given you a denial with a smiling face — they’re wishing you the best in the upcoming battle for reimbursement. Write down the name of the therapist, the date, and the time of the call.


  
You will also have to ask your public insurer to attempt to find you a therapist at least **five times** and list the time and date of the calls in the document to prove they cannot offer you the care you need.

## **The takeaway?**


Therapy is essential — that’s no question. Still, the process you need to go through to find a therapist in Germany can feel more like an additional battle to overcome when you’re already in a rough space.

Surrogates and adoption in Germany

In this article, we talk about everything related to surrogates in Germany for our pride series. Many parents who are unable to have biological children, including gay men, might think about surrogacy for their family planning. But, it’s important to note that surrogacy isn’t only **illegal in Germany, but it’s a criminal offence** for doctors or medical professionals who help someone. This also includes egg donation from one woman to another **for any reason**.

## What the German government says about surrogacy

The word for a surrogate in German is *[Leihmutter](https://www.auswaertiges-amt.de/de/service/fragenkatalog-node/06-leihmutterschaft/606160)*, and it comes from the verb *leihen *or to lend and *Mutter* or mother, so it’s essentially a loaned mother. While the adoptive parents and the children of a surrogate mother aren’t persecuted under the law, they are still not recognized as the parents of the child outside of legal adoption.

Parents who want a child, but are having fertility issues or are not capable of conceiving a child are said to have a *Kinderwunsch*, which literally translates to “children wish” or a desire for children. This can normally be fulfilled through a fertility clinic where a woman will go through hormone treatments, IVF, or purchase donor sperm (which falls into a legal category that egg donation does not).

Women in relationships and single women have the ability to pay for this service. For gay men who are not biologically female, this possibility becomes impossible and often leaves them searching for a surrogate mother or a way to adopt children.

## **Why adoption in Germany is so hard**

The first obstacle that couples might face is Germany’s adoption process. One of the main obstacles is that for every child that is put up for adoption in Germany, there are [anywhere from 6](https://kinderwunschaerztin.de/regenbogenfamilie/) to [10 people](https://beratung.de/recht/ratgeber/adoption-homosexuelle-wie-schwule-lesben-adoptieren-koennen_fnqvie) competing to become that child’s parents. Another problem is that the biological parents have a say in which parents are accepted, so their biases play a role in this as well, which means gay couples face discrimination from both adoption agencies and the biological parents.

For people in a gay marriage or a *Lebenspartnerschaft*, it isn’t possible for both partners to adopt a child. Only one partner can adopt the child and be the sole parent, or they have to go through a successive adoption process where one parent will adopt the child, and the other will apply to have the adopt the child as well afterwards. A *Lebenspartnerschaft* (gay marriage) can be turned into marriage now legally which allows for adoption, but the bureaucratic rules are often more complicated than they seem.

## **Adopting internationally**

The issue of international adoption is often an even worse situation because one partner will have to apply to adopt a child as a single parent without letting that government (in the country they're adopting from) know that they are in a homosexual relationship. There are, however, countries that do allow same-sex couples to adopt. If both parents legally adopt a child in [one of these countries](https://www.equaldex.com/issue/adoption), they can apply to have the adoption recognized in Germany.

The documents needed for this process can be pretty complex since heterosexual couples can adopt a child as the legal mother and father, but for same-sex couples, this becomes a bit strange since gay adoption was only recently legalized. There is little information about this online, so going to an agency that accepts gay couples would be the best place to find more information.

## **How to use fertility treatment in Germany**

For heterosexual partners, if the mother makes use of a sperm bank, her partner is automatically considered the father with her consent. For lesbians going through the same process, this isn’t possible. The second mother will have to go through to adopt the child as their “stepchild.”

Cis homosexual men are limited to the former adoption process because surrogacy isn’t legal.

For people who are gender non-conforming, there is little information out there. The only thing we could find was a couple in [Hessen in 2020](https://www.queer.de/detail.php?article_id=36130) who had a baby, and the parent who identified as non-binary wasn’t recognized as a parent because they couldn’t be added as a mother or a father. The only option open to them was to add their information and gender that was assigned to them at birth.

For transwomen, they only have the possibility of being recognized as the legal father, and for transmen, there is no process for them to acknowledge their rights as a father of a child, so that might only leave them with the rights as the biological “mother” according to German law, or if their partner is the biological “mother” then adopting the child as a step child. Another issue with this is that the German government also apparently uses the gender and name someone was given at birth even after legally transitioning for a child's birth certificate.

The reason why trans* people in Germany face so much discrimination when it comes to becoming a parent most likely has to do with the fact that it wasn’t until 2011 that the German government stopped requiring forced sterilization as a prerequisite to transitioning. This was also the case in Sweden where the government is currently [paying reparations](https://www.regenbogenportal.de/informationen/trans-elternschaft) to the people impacted, and there is a lawsuit against the German government right now asking for the same compensation.

## **International surrogates**

Because the German government is not able to control international surrogacy, they wrote a 75-page document to speak to how they feel about [international surrogacy by country](https://www.bundestag.de/resource/blob/592446/b04363cfd1cf5f6fa65c94b8c48495d9/WD-9-039-18-pdf-data.pdf). In the document, they define what exactly surrogacy is under German law: “When a mother gets pregnant and legally binds herself to give up the child to a third party directly after the child’s birth.”

The problems surrounding surrogate motherhood are a mixture of [exploitation](https://www.theguardian.com/commentisfree/2016/feb/25/surrogacy-sweden-ban) in countries where mothers might not have the ability to find a way to support themselves financially in another way AND purely cultural reasons. One of the main problems surrounding the issue of surrogacy is that both sides feel strongly that they’re right for supporting surrogacy or wanting to abolish it completely. Since we’re an insurance company, we’ll just continue to let you know what the facts are, so you can decide for yourself.

If a couple (regardless if they are same-sex or not) were to hire a surrogate mother in a foreign country to give birth to a baby for them and bring that baby back to Germany, the surrogate mother would have rights as a mother and no other mother would have legal rights as a mother. For gay men, this means that there will only be one legal parent while the other will have to adopt the child as a stepchild (which is already the case for adoption for same-sex couples and for the second mother of a lesbian couple who have children together).

### ***The problems***

One of the main problems is that “it cannot be ascertained that the child can build an undisturbed relationship with the *Wunschmutter* (the mother who desired the child)” [this is our translation from the 75 page document mentioned above]. If two men are adopting a child, then this clearly cannot be ascertained. They also go into more ""hypothetical"" situations to justify the ban on surrogacy like how a child who was from the egg of one woman and birthed from another wouldn't know who their real mother was if the donor mother died, so therefore surrogacy should be banned. While most arguments begin with speaking about exploitation, it seems like biology is a bigger factor in the ban from the German government.

Germany’s stance is to make it unnecessarily difficult for someone to go through with a surrogacy internationally to prevent it from happening.

## **Laws and provisions against medical personnel**

They can go to prison for up to three years for helping a surrogate mother in her endeavour to give up a child to a third party after its birth.

Another thing that isn’t legal is when the egg cell of one woman is used in another woman who gives birth to the child. This is to avoid psychological problems that a child might have when they realize that the woman who gave birth to them is not genetically their mother. In the above-mentioned 75-page document, this appears to be quite the problem with them hypothesizing how a child might feel if the woman who gave birth to them was dead and what sort of identity problems that might cause. There is no exception for lesbians.

As for sperm donations, the only law in place is that the sperm of a dead person is not allowed to be used. The reason this is still legal is that it is assumed that the loss of a genetic mother could cause psychological problems while the loss of a genetic father will apparently not.

*The reason why only doctors, fertility clinics, and medical professionals are criminalized is that the donor or surrogate mothers are almost always acting out of altruistic measures, and it is up to professionals to keep them safe* according to the German government.

There is a lot surrounding this topic, and we were only able to provide the basic information. We hope that this has helped at least provide a bit of insight into surrogacy in Germany.

A simple search of “Hauzarzt/GPs near me” will generate a list of doctors and their credentials according to your location, as well as any other keywords you may have included in your search. Another bonus of sourcing medical providers via search engines like Google is that you can read reviews from past and existing clients.

## **How can I visit a GP after finding a doctor in Germany?**


Once you find the right doctor for you and your [application for public health insurance](https://feather-insurance.com/health-insurance/public) has been approved and processed, you will receive confirmation – digitally, via post, or both – from [Feather](https://feather-insurance.com/) and your chosen provider. You will receive your health insurance card as further confirmation of your legally insured status (Krankenversicherungskarte). Once you have your health insurance card, you can attend medical appointments as you usually would in your country of origin.

Health insurance cards are becoming more common because of the ease of registration when attending in\-person appointments, but private insurance providers are not required to supply them to their customers. ## **Do you need a GP in Germany?**


While you’re best advised to build a relationship with one doctor for reasons of ongoing medical care, you’re not required to remain with the first doctor you visit. As a legally insured person in Germany, whether through public or private health insurance, you can see different doctors throughout a calendar year.
